The Irene Diamond Fund — established suit underwear by the late Irene and Aaron Diamond — wants to give $40 million to programs for the aging.

But the money is tied up in a Roosevelt Island Mitchell-Lama building in which Aaron was an investor, the suit says.

Now lawyer David Hirschhorn, who controls a significant stake in the real estate, is refusing to sign over his rights, which would allow the sale, without a 55 percent fee, the suit says.

As a managing general partner who owns a minority share of the 361-unit building, Hirschhorn would normally be entitled to a 20 percent cut of the sale of those shares, the suit says.

But in 2012, he allegedly struck a “self-interested” deal to increase his stake to 55 percent.

Robert Boller, attorney for Hirschhorn, said, “We look forward to having our day in court and the dismissal of this baseless suit.”

The trouble between Mary Lou Malczewski and wholesale swimwear Irina Zamfir — who is engaged to Malczewski’s ex, William — began in 2013 with the ex-wife hurling racial slurs at the Romanian beauty via text andthreatening her life, according to the lawsuit filed Thursday in Brooklyn federal court.

The mom of two also twice phoned Zamfir’s bosses in a failed effort to get her fired for “engaging in inappropriate sexual activity” in the office, the suit alleges.

The row between the two women, both 47, escalated when two years later, Malczewski was arrested for allegedly attacking Zamfir and stealing her cellphone at a shopping center.

Malczewski and her ex — a ­retired NYPD officer — finalized their divorce in February 2015, sources said.

Zamfir is suing the NYPD and Malczewski for unspecified damages. Malczweski didn’t return a message seeking comment.
